STEPPING IN THE RIGHT DIRECTION PARTICIPANT TERMS AND CANCELLATION POLICY
The following is a binding agreement between the parties. The terms “we”, “us”, “our” “STRD” and “Stepping in the Right Direction” refer to Stepping in the Right Direction. By booking your travel with us, you as the Participant or Parent/Legal Guardian of Participant (the “Participant”, “you”) are agreeing to be bound by these Terms and Conditions together with any other documents we give you, and any additional terms and conditions of any Suppliers that are applicable to your travel arrangements (The Agreement). The Agreement describes what you are legally entitled to expect from us when you book a trip through us, in addition to important obligations you enter into that effect your legal rights. Please be aware that these terms and conditions contain waivers of liability as well as a waiver of class action and venue selection and notice clauses. Therefore, it is of vital importance that you read The Agreement in its entirety.
CHANGES TO THESE TERMS AND CONDITIONS. Stepping in the Right Direction reserves the right, in our sole discretion, to change these Terms and Conditions at any time. Upon making changes, we will notify you via the email address you provide to us at booking. The current Terms will apply to your booking. You must therefore be familiar with the Terms in effect at the time you book. Your continued use of our services including continuing to use or maintain any bookings after notice of any changes to the Terms and Conditions constitutes your consent to the changes.
COVID 19 RELEASE OF LIABILITY. By booking a tour at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors for whom you as a guardian or parent have granted permission to participate in the trip, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that exposure to such viruses or diseases is an inherent risk of traveling, that cannot be controlled or eliminated by Stepping in the Right Direction.
In order to attend a tour, we require proof of COVID-19 vaccination to be provided prior to departure. In addition, all participants may be required to wear masks and social distance as required by tour leaders, and any sites that are visited. Failure to comply with these requirements will result in the participant being sent home, for which there will be no refund.
You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or canceled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. Some locations may require you to have a vaccination or proof of negative testing. On your return home, additional testing, requirements, or documentation may be required. You are responsible for understanding these requirements and must not rely on Stepping in the Right Direction to provide these details. You understand that you may become sick before, during, or after the tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.
You agree that due to uncertainty caused by COVID 19, Stepping in the Right Direction has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, Stepping in the Right Direction shall not be liable to any losses howsoever arising. We are not liable should travel protection not cover COVID-19 related illness, injury, or cancellation.
You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives, and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS Stepping in the Right Direction, its members, officers, agents, and/or employees, suppliers, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.
You must make all payments in accordance with the payment schedule provided in the email we send to you. Each installment that is late will be charged $15 per participant. Participants will not be permitted to participate in the Tour if their account is not paid in full. Accounts must be paid full 30 days prior to departure. Stepping in the Right Direction reserves the right to cancel your tour due to insufficient funds or non-payment. Cancellation for non-payment will be subject to the cancellation terms.
While we do accept major credit cards including Visa, Mastercard, American Express, and Discover, participants must provide to us a click or signed authorization for every transaction for your trip. Your authorization is an agreement for us to charge your card and an acknowledgment and agreement to these terms and conditions including the cancellation terms. As such you agree not to make any improper chargebacks.
In certain cases, participants can dispute charges with credit card companies (“chargebacks”). Before initiating a chargeback, we ask participants to first call us to discuss any questions or concerns about our charges. We will work with participants in attempting to resolve concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Stepping in the Right Direction retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims:
- Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
- Chargebacks resulting from charges authorized by family, friends, associates, or other third parties with direct access to your credit card. This does not include credit card fraud.
- Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.
- Chargebacks resulting from force majeure or other circumstances that are beyond the control of Stepping in the Right Direction or the Supplier.
- Chargebacks resulting because you do not agree with the cancellation policy.
Fuel Surcharges, Taxes, and Other Fees
The Tour price includes all known surcharges (fuel, taxes, and other fees) known at the time the group contracted with Stepping in the Right Direction. However, given the volatile nature of fuel prices, suppliers (for example, airlines and coach carriers) at times must assess a fuel surcharge that is not known by any party at the time of contracting service. You will be informed of any fuel surcharge prior to your final payment due date. No surcharge will ever be assessed after the final payment due date.
Additionally, for air tours, airline bag fees, unless otherwise indicated on the Tour Agreement or Parent Letter, are NOT included in the price of the Tour and are the responsibility of the individual or group checking bags or instruments.
Occasionally a governing body will add a tax after transportation has been contracted. Any taxes not in existence at the time the Tour was contracted will be assessed back to the group.
It is important to know that Stepping in the Right Direction works closely with all its suppliers to eliminate or minimize any surcharges related to fuel, taxes or fees. In recent years we’ve been able to absorb many small increases and not pass them back to our travelers. Given the rising price of fuel, it’s important to know a fuel surcharge could be assessed if the price of oil continues to increase.
The Tour price is based on the projected number of Tour participants, Tours that operate below the projected number are subject to price adjustments based on fixed costs. You will be notified of any surcharges in advance of final invoicing. You are responsible for any increases in cost due to a tour that does not meet the tour minimums.
Current Cancellation Policy:
*The Registration Fee equal to $500.00 is non-refundable and required to reserve a seat on the tour.
Prices are subject to the location of travel.
If STRD has to postpone for any reason, other than a force majeure event, students will be transferred to another tour.
If an STRD HBCU Tour participant has to cancel, the below cancellation policy will apply:
Cancellation Policy: You, as the participant and/or the person making the payments on behalf of the student, have expressed your intention to enter into an agreement with Stepping in the Right Direction for one of its College Tours. You have expressed this intention by completing a registration form. This Non-Refundable Deposit & Cancellation Policy covers all payments made to Stepping in the Right Direction.
Your tour seat is reserved only when you register for the tour (“Registered Tour”) and make your payment of the non-refundable deposit of up to $500.00. The non-refundable deposit is paid by you in order to register and reserve your date and Registered Tour and is non-refundable in the event that you cancel your reservation for the Registered Tour for any reason and at any time.
Under NO circumstances will your payment(s) up to $500.00 non-refundable deposit be refunded.
Cancellations and Refunds of Installments
The rest of your payment for the tour you register for is made usually in one (1) to four (4) payments (“Balance Payment”). Each payment becomes non-refundable upon receipt.
Your signature below confirms that you have read and approved this Non-Refundable Deposit & Cancellation Policy. You agree not to initiate any chargebacks or disputes through your credit card company or through PayPal that conflicts with this Non-Refundable Deposit & Cancellation Policy.
If the reason for cancellation is covered under the terms of your travel protection plan you may be able to reclaim these charges, for this reason, we strongly encourage the purchase of a travel protection plan including additional cancel for any reason coverage.
Changes and Cancellation by the Supplier
We will inform you as soon as reasonably possible if a supplier needs to make a significant change to your confirmed booking or to cancel. We will also liaise between you and the supplier in relation to any alternative arrangements offered by the supplier, but we will have no further liability to you. Suppliers may choose to provide a travel voucher or credit in lieu of a refund. We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency.
While no changes are anticipated after you receive the final itinerary, there may be occasions when certain alterations become necessary. These can be due to religious holidays, national celebrations, or unforeseen events including weather, governmental closures, acts of God, or any other reason. We and our suppliers reserve the right to change the itinerary due to unforeseen circumstances or emergencies. Additionally, colleges undergo renovations from time to time which can obscure viewing or otherwise change the nature of visiting these sites. No tours will be canceled due to renovations, although we may choose to amend itineraries for such sites. These changes will not be considered material changes and will not be considered cause for cancellation by the sponsor or participant.
If we suggest alternate activities in place of a planned stop or in the case of leisure time, such suggestions do not constitute our endorsement. In such a case you and participants will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity.
Without limitation, Stepping in the Right Direction will make no refund for and is not responsible for any matter beyond the control of Stepping in the Right Direction, including but not limited to the negligent or willful acts of others; acts of God or force majeure, weather emergencies, breakdown, or failure of diving or mechanical equipment, government actions, inclement weather, sickness, attacks by animals, availability of medical care or the adequacy of the same, criminal activity of any kind, terrorism, war, civil disturbance, sanitary conditions, quality or sanitation of food, , quarantine, customs, regulations, epidemics, pandemic, closure by governments, strikes, hotel overbooking or any other unforeseen circumstances or any other factors unforeseen by Stepping in the Right Direction that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you less our non-refundable deposit.
Accident and Illness Protection for US Domestic Tours
If purchased, Accident, illness, and accident-related dental insurance coverage are provided for participants. Limits per single occurrence are $5,000 for the accident, $1,500 for illness, and $750 for accident-related dental. Any charges not covered by the purchased insurance are the responsibility of the participant. Pre-existing conditions are not covered under most policies. Complete terms and conditions of insurances available are from Travel Guard.
Stepping in the Right Direction strongly recommends participants purchase travel/medical/baggage insurance for the trip including additional Cancel for any Reason Coverage. Such a plan at a minimum should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections, and baggage loss.
Stepping in the Right Direction is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel protection plans. Stepping in the Right Direction cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent, or broker.
Declining travel protection plan coverage could result in the loss of participants’ travel costs and/or require more money to correct the situation. Participants also acknowledge that without this coverage, there may be no way to recoup any losses, costs, or expenses incurred. If participants choose to travel without adequate coverage, We will not be liable for any losses howsoever arising, for which trip protection plan coverage would otherwise have been available.
We use our best efforts when creating rooming lists. We will not be liable for any claims for injury, damage, or emotional injury or harm, or claims based on sexual orientation due to rooming list decisions.
Limitation of Liability
Stepping in the Right Direction purchases transportation, hotel, and other services from various independent suppliers that are not subject to its control. Neither Stepping in the Right Direction its affiliates, owners, officers, agents, employees, nor any associate organization shall be held liable for any act, default, injury, loss, expense, damage, deviation, delay, curtailment, or inconvenience caused to or suffered by any person or their property, howsoever arising, which may occur or be incurred by any organization or person, even though such act, default, injury, loss, expense, damage, deviation, delay, curtailment or inconvenience may have been caused or contributed to (a) by the act, neglect or default of Stepping in the Right Direction, or of any persons for whose acts it would otherwise be responsible, or (b) defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers. You further understand that Stepping in the Right Direction neither owns nor operates such third-party suppliers and accordingly, agree to seek remedies directly and only against those suppliers and not hold Stepping in the Right Direction responsible for their acts or omissions. In no event will Stepping in the Right Direction be responsible for incidental, consequential, or special damage or loss suffered by any person. Stepping in the Right Direction’s maximum liability, for any reason whatsoever, will be limited to the amount paid to Stepping in the Right Direction for its services.
Acknowledgment of Risk
You understand and acknowledge that your travel in connection with and participation in the tour arranged at your request by Stepping in the Right Direction may involve risk and potential exposure to injury. You also realize and acknowledge that risk and dangers may be caused by the negligence of the owners, directors, employees, contractors, officers, or agents of Stepping in the Right Direction or the negligence or participation of other participants, contractors, and/or subcontractors to Stepping in the Right Direction. You also recognize and acknowledge that risk and dangers may arise from foreseeable and unforeseeable causes, including weather and other acts of nature. You fully understand and acknowledge that the aforementioned risks, dangers, and hazards are a potential in connection with recreational activities which may take place during your journey.
Express Assumption of Risk and Responsibility/Participation
In recognition of the inherent risk of the travels and related activities in which you are intending to engage, you confirm that you are physically and mentally capable of participating in the activity, that you are willingly and knowingly electing to participate in this tour in spite of the potential risk of danger, and you willingly and voluntarily assume full responsibility for any injury, loss or damage suffered by you or caused by you, whether caused in whole or in part by the negligence of the owners, directors, agents, officers, employees, or contractors of Stepping in the Right Direction. You understand and acknowledge that reserves the right to accept or reject any participant for any reason, and Stepping in the Right Direction or its guide has the right to disqualify you from any trip activity if in Stepping in the Right Direction’s or such guide’s judgment, you are incapable of that activity and/or your continued participation in the tour will endanger yourself or the safety of the group. It is your responsibility and obligation to inform Stepping in the Right Direction, at the time your reservation is made, of any medical or physical disability or limitation that might disable you or render you unable to perform or safely complete the tour or any activity on the tour. You further acknowledge that you are the best judge of your own conditions and limitations and that it is incumbent upon you to fully disclose the full extent of any such conditions or limitations to Stepping in the Right Direction.
Release of Liability
In consideration of the services and arrangements provided by Stepping in the Right Direction, you, for yourself and for your heirs, personal representatives or assigns, do hereby release, waive, discharge, hold harmless and agree to indemnify Stepping in the Right Direction, and its owners, officers, directors, employees, and affiliates from any and all claims, actions, or losses for bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection with the scheduled travel package and any activities conducted in conjunction therewith. You specifically understand and agree that you are releasing, discharging, and waiving any claims or actions that you may have presently or in the future for the negligent acts or conduct of the owners, directors, officers, employees, agents, or affiliates of Stepping in the Right Direction.
Express Waiver of Consequential Punitive or Exemplary Damages
Regardless of the situation or circumstances giving rise to a claim, you waive any right to seek consequential, punitive, or exemplary damages against Stepping in the Right Direction, its owners, officers, directors, volunteers, agents, contractors, and employees, for any reason whatsoever. Safety and/or security standards at hotels or other accommodations, or for any other reason beyond the control of Stepping in the Right Direction. You understand, agree with, and agree to be legally bound by the terms of the release and waiver of liability set forth herein.
Governing Law and Jurisdiction
These Terms and Conditions and any actions and proceedings brought hereunder shall be governed by the laws of the State of California without regard to conflict of laws principles. Any action or legal proceeding to enforce any provision hereof, or based on any right arising out of, these Terms and Conditions shall be exclusively in the courts of the State of California, or if it has or can acquire jurisdiction, in the United States District Court for the County of Los Angeles, and all of the parties hereto hereby consent to the exclusive jurisdiction of such courts and of the appropriate appellate courts in any such action or legal proceeding and waive any objection to venue or jurisdiction in connection therewith. Stepping in the Right Direction shall not, in any case, be liable for anything other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Stepping in the Right Direction unless you have first provided a typewritten notice of claim to Stepping in the Right Direction within 30 days after the tour or cancellation of the trip.
Waiver of Class Action
You agree that you will only bring claims against Stepping in the Right Direction in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding.
The invalidity or unenforceability of any part of these Terms and Conditions, or the invalidity of its application to a specific situation or circumstance, shall not affect the validity of the remainder of these Terms and Conditions, or its application to other situations or circumstances. Any provision of these Terms and Conditions held invalid or unenforceable only in part or degree will remain in full force and effect to the extent not held invalid or unenforceable.
Any failure by either party at any time, or from time to time, to enforce or to require the strict keeping and performance of any of the Terms and Conditions shall not constitute a waiver of any such Terms and Conditions and shall not affect or impair such terms and conditions in any way or the right of such party at any time to avail itself of such remedies as it has for the breach or breaches of such terms and conditions
By signing below, you acknowledge that you have read, understood and agree to all of the Terms and Conditions above and agree to be bound by them, and the terms and conditions of our suppliers, and that such agreement is a condition of joining the tour. You further acknowledge that you have been informed of and understand the cost and dates of the tour and the campuses that will be visited. You agree that in order to participate, you must sign and agree to the code of conduct, registration form, and health form. You agree that the code of conduct, registration form, and health form are incorporated in these Terms and Conditions. You agree that Stepping in the Right Direction in its sole discretion can refuse any participant on any trip.
KNOWING AND VOLUNTARY EXECUTION.
I, the undersigned, have carefully read and fully understand the contents and legal ramifications of this Agreement. I understand that this is a legally binding and enforceable contract and sign it of my own free will. I agree that if any portion is found to be void or unenforceable, the remaining portions shall remain in full force and effect. No additions, deletions, or changes can be made to these Terms and Conditions, and signing it is a requirement for joining the trip.
BY SIGNING BELOW THE UNDERSIGNED REPRESENTS AND WARRANTS THAT THEY HAVE READ THE ABOVE TERMS AND CONDITIONS AND AGREE TO BE BOUND BY THEM. THE UNDERSIGNED FURTHER REPRESENTS THEY HAVE THE AUTHORITY TO SIGN THIS WRITTEN AGREEMENT ON BEHALF OF ALL INDIVIDUALS WHOSE LEGAL RIGHTS THIS AGREEMENT CONTEMPLATES WAIVING.
